Welcome to Nobody Models. These Terms of Service ("Terms") govern your access to and use of our website, services, and AI-powered image generation platform (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you confirm that you:

• Are at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Agree to comply with these Terms and all applicable laws

If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Nobody Models provides an AI-powered image generation platform that allows users to create photorealistic visual content. The Service includes:

• AI image generation using text prompts and reference images
• A credit-based system for generating images
• Storage and management of generated images

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Credits and Payments

4.1 Credit System

Image generation requires credits. Free accounts receive a limited number of complimentary generations. Additional credits can be purchased through our platform.

4.2 Pricing

All prices are displayed at the time of purchase. We reserve the right to modify pricing at any time, with changes effective for future purchases only.

4.3 No Refunds on Used Credits

Credits that have been used for image generation are non-refundable, as each generation incurs computational costs. Please see our Refund Policy for full details.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate content depicting real individuals without their consent
• Create deepfakes, non-consensual intimate imagery, or defamatory content
• Produce content that is illegal, harmful, threatening, abusive, or harassing
• Generate content that infringes on intellectual property rights
• Create content involving minors in any inappropriate context
• Produce hate speech or content promoting violence or discrimination
• Generate misleading content intended to deceive others
• Circumvent any technical limitations or security measures
• Use automated systems or bots to access the Service without permission
• Resell or redistribute generated content as stock imagery without a commercial licence

We reserve the right to suspend or terminate accounts that violate these guidelines without refund.

6. Intellectual Property

6.1 Your Content

You retain ownership of any reference images you upload. By uploading content, you grant us a limited licence to process it for the purpose of generating images.

6.2 Generated Images

Subject to these Terms and your compliance with them, you are granted a licence to use images generated through the Service for personal and commercial purposes. This licence does not extend to:

• Content generated in violation of our Acceptable Use policy
• Resale of generated images as stock photography (without a commercial licence)

6.3 Our Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Nobody Models and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Generated images will meet your specific requirements
• Results will be accurate, reliable, or suitable for any purpose

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOBODY MODELS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Nobody Models, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or generate using the Service

11. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination:

• Your right to use the Service ceases immediately
• Unused credits may be forfeited
• We may delete your account data after a reasonable period

You may close your account at any time by contacting us.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
